Ok I need help… My legal know how is effected by being close to the issue as such I can’t be objective.

The Health Service Commissioner (or Health Service Ombudsman) draws her powers almost wholly from the Health Service Commissioners Act 1993, as since amended.

in the above index is a section called “Independent providers subject to investigation.
it sates….

(1)Persons are subject to investigation by the Health Service Commissioner for England if
(a)they are [or were at the time of the action complained of] persons (whether individuals or bodies) providing services in England under arrangements with health service bodies or family health service providers, and
(b)they are not [or were not at the time of the action complained of] themselves health service bodies or family health service providers.

That to me gives the PHSO the power to investigate my complaint about Blackheath.

Blackheath being an independant provider enpoweded by the NHS to provide me rehabilition

Is my assessment of this correct?

UPDATE –

I should say I not after a binding answer – just enough to be justified in making the argument with the PHSO
